Please read the following End-User Licence Agreement carefully before downloading Poker Evolver

This End-User Licence Agreement ("EULA") sets out the terms that apply to Poker Evolver software ("Software").

IMPORTANT: Read the following carefully before using the Software:

This EULA is a legally binding agreement between you and Sysdrone Ltd ("Sysdrone") applicable to your purchase of the Software. By clicking on the "I Agree" button, you agree to be bound by the terms of this EULA and accept the licence terms of third party libraries used by the Software. If you do not agree to be bound by the terms of this EULA, click on the "Cancel" button and do not subsequently download or install the Software.

1. GRANT OF LICENCE

Sysdrone hereby grants to you a limited, non-exclusive licence to use the Software subject to the following terms:
- You may install the Software on one desktop or laptop personal computer. You can take copies of the Software only as far as may be necessary for the purposes of routine security backups of the personal computer that it is installed on provided that such security backups include all original proprietary notices.
- You may not modify the Software and you are not (save to the extent that such acts may not be prohibited by law) permitted to reverse engineer, decompile, translate, disassemble or create derivative works from the Software. You are not permitted to distribute, sell, rent or sublicense the Software and you are not allowed to transfer your licence to someone else.
- You may only use the Software in a manner that compiles with all applicable laws in the countries in which you use it including restrictions concerning copyright and encryption.
- You are not permitted to assign any or all of the burden or the benefit of this EULA without our express prior consent.
- You agree that Sysdrone and its partners may receive, collect, store and use technical information in the course of the registration, and during the use, of the Software. Sysdrone will handle such information in compliance with applicable privacy and data protection laws.

If you have downloaded an evaluation version of the Software, you are entitled to use the Software, free-of-charge, strictly for the sole purpose of evaluating the features and usability of the Software, until a database of the Software contains one thousand and five hundred (1500) hands or more. The evaluation version may not have all the features that are available in a commercial version. Furthermore, the limited warranties in section 2 below will not apply to the evaluation version of the Software.

If you have downloaded a beta version of the Software or upgraded your earlier version to the beta version, you are entitled to use the Software, free-of-charge, strictly for the purpose of testing the features and usability of the Software, during beta testing period. User experience of a beta version may differ from a commercial version. Beta version may lack the usability and features of a commercial version. Furthermore, the limited warranties in section 2 below will not apply to the beta version of the Software. Sysdrone reserves the right to end your right to use the beta version of software any time without notice.

If you have downloaded a separate commercial version of the Software or upgraded your earlier evaluation version to the commercial version, you are entitled to use the Software perpetually, subject to the payment of applicable licensing charges. In case you are not totally satisfied with the Software, please contact the support of your local dealer and ask for a money-back guarantee. After the licensing charges have been refunded, your right to use the commercial version will end immediately.

All intellectual property and other ownership rights in the Software, including copyright, patents and trade secrets protected under Finnish and international laws and conventions, are and remain the property of Sysdrone or Sysdrone's licensors. This EULA is not a sale of the Software. Except for the licence rights expressly granted to you herein, you will have no right, title or interest in the Software.

2. LIMITED WARRANTIES

Sysdrone warrants that for a period of ninety days from the date of your acceptance of this EULA on the first installation of the Software by you, the Software if operated as detailed in the related documentation, will substantially perform the functions described in the documentation. Sysdrone shall not warrant that your use of the Software will be free from interruptions or error free. If the Software is provided on a physical medium supplied by Sysdrone, Sysdrone warrants that such medium will be free from defects in materials and workmanship.

The sole liability of Sysdrone for a breach of this warranty is at Sysdrone's election:
- To replace any defective medium on which the Software is supplied;
- To advise you how to achieve the required functionality via an undocumented procedure; or
- To refund the licence fee for the Software.

AS FAR AS IT IS LEGALLY PERMITTED TO DO SO, SYSDRONE EXCLUDES ALL OTHER WARRANTIES EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF NON-INFRINGEMENT AND WARRANTIES THAT THE SOFTWARE IS FREE OF DEFECTS, MERCHANTABLE, OF SATISFACTORY QUALITY, OR FIT FOR A PARTICULAR PURPOSE, SUCH AS THE PREPARATION OF ANALYZES ON ANY POKER GAME. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS EULA. NO USE OF THE SOFTWARE IS AUTHORISED EXCEPT UNDER THE TERMS OF THIS EULA.

The limited warranty contained in this section does not apply where:
- The Software is modified.
- The medium on which the Software is supplied is damaged by accident while in your possession or by improper use by you.
- If the Software is used on hardware or in conjunction with software other than the unmodified software and hardware on which it is designed to operate as described in the related documentation.
- Access to Internet as required by the operation of the Software has not been enabled or has been prevented (the Software will automatically verify the registration codes through Internet, and may also automatically check for updates and fixes, which will be automatically downloaded and installed).

IN NO EVENT WILL SYSDRONE OR ANY DISTRIBUTOR OF SYSDRONE BE LIABLE TO YOU FOR ANY DAMAGES, DIRECT OR INDIRECT,  (INCLUDING SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES OR FOR ANY CLAIM BY A THIRD PARTY, AS WELL AS ANY LOSSES INCURRED IN THE COURSE OF POKER GAME OR BASED UPON THE USE OF SOFTWARE) ARISING OUT OF THE USE OF (OR THE INABILITY TO USE) THE SOFTWARE AND WHETHER OR NOT SYSDRONE OR ANY DISTRIBUTOR OF SYSDRONE IS AWARE THAT ANY LOSS MAY OCCUR. IN NO EVENT SHALL SYSDRONE'S LIABILITY OR THE LIABILITY OF ANY DISTRIBUTOR OF SYSDRONE EXCEED THE LICENCE FEE FOR THE SOFTWARE.

If you are a consumer acting outside the course of a business, this warranty does not affect any statutory rights you may have.

3. INDEMNITY

You agree to indemnify Sysdrone, and employees, directors, representatives, suppliers, agents and service providers of Sysdrone against any failure by you to observe the provisions of this EULA and for all losses, damages and all reasonable expense and costs, including legal fees, incurred by Sysdrone or them in third party claims arising out of the breach of your obligations under the terms of this EULA.

4. TERMINATION

Your licence to use the Software will terminate automatically and without notice if you are in breach of any of the terms of this EULA. Sysdrone may by three months' notice terminate the use of the Software. Upon any termination of this EULA, you shall immediately discontinue use of the Software.

5. LAW

This EULA is governed by the laws of Finland with the exception of any choice of law provisions. Any disputes arising out of or in connection with this EULA will be settled by the District Court of Helsinki.

6. WAIVER

Any failure or neglect by either party to enforce at any time any of the provisions of this EULA shall not be construed nor deemed to be a waiver of that party's rights under this EULA.

7. SEVERABILITY

If the whole or any part of any provision of this EULA is determined to be invalid or unenforceable then such provision or part thereof shall be severed from the body of this EULA which shall continue to be valid and enforceable to the fullest extent permitted by law.

8. ENTIRE AGREEMENT

This EULA (including any proposal, quotation, order or other document referred to herein) constitutes the entire agreement between you and Sysdrone and supersedes all prior representations, agreements, negotiations or understandings with respect thereto, whether oral or in writing.  Any amendment to this EULA shall not be effective unless it is made in writing, expressly purports to amend the EULA and is executed by both parties.

By clicking on the "I Agree" button, you agree to be bound by the terms of above End-User Licence Agreement and accept the licence terms of third party libraries used by the Poker Evolver.

Clicking on the "I Agree" button also starts downloading evaluation version of Poker Evolver.

Poker Evolver requires .Net Framework 2.0 or newer to work.
If you don't have it, please download and install it before installing Evaluation Version of Poker Evolver.
NOTE: Windows Vista already includes .NET framework 3.0.
